The Netherlands Authority for Consumers and Markets has published a policy rule stating that consumers and companies should be allowed to choose their modem and router themselves, and that the telecom provider has no right to prohibit this.The rule will take effect in early 2022.According to the ACM, consumers and companies have the right to use a different modem or router.This is stated in the ACM's policy rule Enforcement End Devices Decree.This policy rule describes exactly which part of the network the consumer has free choice.It also generally states what information telecom operators must publish so that consumers know which routers and modems are suitable for the network.According to ACM, the free choice of modem is laid down in European rules of BEREC, the association of European telecom regulators, and ACM is the designated supervisor for these rules.That is why it has clarified the free modem choice in its own policy rule.Telecom providers have six months to prepare for the new rules;they go into effect early next year.The Netherlands Authority for Consumers and Markets has been working on the new rules regarding free modem choice since 2018.These were previously postponed to the end of 2019. In mid-2020, ACM said that the new rules would come into effect in 2021.That will now be early 2022.
